We punish bad persons all the time.
1: People taking drugs in America go to jail for years even though their actions hurt no one. (I'm really not trying to open this can, but the argument kinda works... at least for those drug addicts they actually hurt no one)
2: We also stop (at least in australia) pedophiles who have served their time in prison, from leaving prison because they're deemed to be dangerous. Isn't this punishing a bad person... for being a bad person?
3: If you don't take these two points, think about the fact that when sentencing judges are supposed to take into account the 'protection from society' as well as punishment, rehab etc. So if we can show a rapist is worse than a murder for society then you could possibly say we should heighten their punishment.
