as a little background, ive done really well for this particular sub this sem. ive got 33/40, which is like barely out of hd range.

my final is worth 60 marks and its generally the easiest part of the course because its GENERALLY really easy to predict the exam questions. typically all thats ever asked is murder/manslaughter + assault and indecent assault.

the essay question for the last 5 years has been 'criminalize this' or 'what are the problems with criminalizing this type of behavior'.


so i get all my notes together organise them properly and take a stab in the dark and assume "this year its going to be how to deal with stds within the criminal system, because hey... that hasnt been done yet in past papers and its been discussed by the un somewhat recently, it would make sense to be in the exam as the policy question...



so i go in pretty chill like boss nigger open the paper and read the legal problem... mother fucking jesus christ fuck shit bitch ass... the entire thing is pretty much on robbery with a homicide right at the very end (which can only be proved through constructive murder... eg. YOU MUST FUCKING PROVE THE ROBBERY!!!) and the mother fuckers didnt even make the robbery nearly clear cut, throughout the entire thing it seemed like no one meant to do anything so its a complete mess.

anyway i decide to start at assault charges because i think thatll be easiest, and an hour and a half later... im through 1/4 of the first question. (its a 3 hour test)

i start scribbling like a mad man and get the first part done in the next half hour, but im not thrilled about how it went. so im like... ok its fine... ill make up for it in the next part. to my shock the next question is not a policy question (which is what its meant to be... and what its outlined as in the course outline) but its a "hey look through your fucking text book and find all the references to reasonable or ordinary person... then tell us how they differ from each other."

im pretty sure the person next to me was in the same boat as i was because he literally swore half way through the exam loud enough to make me and a couple of other people notice lol.

so anyway, i say... ok its not what i prepared and its a little vague but its probably easier than the other option. so i open up my notes and think im being really clever. i ignore the tests i think are too easy (eg. objective element in provocation) and instead chose really controversial ones like insanity (where 'abnormality of the mind' is defined as that which an ordinary person would term 'abnormal') and this next one which fucked me over so hard...

there difference between strict and absolute liability is generally 'honest and reasonable mistake of fact'. and i remember this, and say... holy shit thats a good one! so i write away, then it dawns on me...

the context i used it in was strict liability for sexual intercourse with a consenting minor, in which the aussie govn attempted to make absolute liability some time recently(10years ago or something idfk...) meaning there is no excuse at all for doing it ever. the hca then decided that they would reintroduce the test in common law as 'honest mistake of fact' removing reference to the reasonable bit. (meaning anyone who has an honest belief that the person consenting to them is 18 regardless of how reasonable it is is not liable for the offence of sexual assault.) thats all well and great... but its no longer an objective test at all.

do they really give you an exam case with the task to criminalize fucking everything? i mean is there an option that there is no liability and you can arrive at such a conclusion?

most of the time they want you to identify why things shouldnt be (or what difficulties may rise) criminalised rather than to actually go ahead and do it.


my crim 1 paper though i had a laugh and ACTUALLY criminalised smoking in non-private areas(or around non-consenting people and minors). :boosh:
