well i think the legal definition of murders should be the one we are using.



if we want to take only the worst murders and the worst rapes, i think youll find a concerning issue being they tend to be commited by people who do both, and on top of this... people who if we were to be honest with ourselves, are insane.

a lot of the time we dont allow these people to plead insanity in front of a jury because of the non-legal presumption that a person who commits such atrocities must undoubtedly be insane. this would put those highest threshold of killers not in prisons but in mental asylums.

so as a policy decision we just say "ok guys those really brutal rapes and murders we cant really let slide so its too bad for the accused, but it doesnt matter how much mens you were actually capable of having. you going away for life son."

contrast this with rape cases, where people have been raped at knife/gun point on trains / in car parks where people "gave in to temptation" which is not a legal excuse to commit a crime. those people are fully culpable and i would say more so than people who kill people because they are insane.
