Primero. Por escrito presentado el siete de abril de dos mil once ante el Pleno de la Suprema Corte de Justicia, PODBAD, por conducto de su apoderado legal, Joe Space, solicito el recuse del ministro ponente Nrom Gustav en base a acusaciones de bias pre-existente al arribo del asunto a la Corte.


CONSIDERANDO

Primero. Este pleno de la Suprema Corte de Justicia de la nacion es competente para conocer del presente recurso de revision en terminos de lo dispuesto en los articulos 107, fraccion VIII, inciso a) de la Constitucion Politica de los Estados Unidos Mexicanos; 84, fraccion I, inciso a), de la Ley de Amparo y 21, fraccion II, inciso a) de la Ley Organica del Poder Judicial de la Federacion.

Segundo. Este pleno considera que la parte acusadora, presento unicamente pruebas testimoniales para fundamentar la accion de recuse del ministro poniente, insuficientes por si solas.

SENTENCIANDO

Primero Esta corte por tanto rechaza la mocion de recuse de la parte acusadora, al estar insustanciada, y al ser este Pleno de la Suprema Corte de Justicia de la Nacion, la ultima instancia a la que puede recurrir la accion, se da por definitiva esta sentencia.
