was talking with chunky on ts about this.


in the eyes of the law the most serious offences are ones where you take away the liberty of another (thus the legal requirement of "beyond a reasonable doubt" in crim law) and of course murder followed by false imprisonment are the highest forms of this.

however in society i would say rape is defiantly the worse of the two. the reason is pretty simple, most murders are crimes of passion or :manslaughters:

sure there are some really violent murders which are worse than rape, but in general a rape where YOU ARE AWARE THERE IS NO CONSENT is a much more culpable act than killing your wife who was cheating on you with your grandpa.


this is highlighted by a tonne of "excuse based" partial defences like provocation, as well as some complete defences for stuff like self-defence and necessity, where your or someone else would have been in foreseeable peril should you not have acted as you did.

whereas there is really none of the same for rape, it is never acceptable no matter how sexually deprived you are to have your way with an unwilling person. (i guess duress would be an interesting defense for it? will have to chat with chunkster about this later.)



but lets face it... neither of them are exactly acceptable. i would just say that while a murderer is usually a once off crime, unlikely to repeat offend, rapists tend to stick to it.

ps. justifiable homicide is also murder.

so you cant tell me that is worse than rape.
